The noise about the controversial Samoa agreement is quite good for Nigeria's democracy. It is a sign that many Nigerians are awake and will not sit and watch while the government foist belief and principles that are against their cultural and religious convictions.
However, while the reactions are a welcome development, there is also a concern about how people (media practioners) swiftly take a stand or make declarations on a document they have not read to see the said controversial provisions and how they are worded.
It's been alleged by some Nigerians that certain Articles of the Agreement especially Articles 2.5 and 29.5 legalise or recognise LGBT, transgenderism, abortion, teen sexual abuse, and perversity in African countries.
They could be right, but as long as we are yet to see the provisions as worded in that agreement as originally captured or reproduced verbatim, should we, media practitioners join the fray and conclude that the agreement lords Lesbian, Gay, Bisexual, and Transgender (LGBT) clauses on Nigeria just because some Nigerians frowned upon what they thought was the recognition of LGBT rights?
The critics have said that signing of the Agreement by Nigeria constitutes a threat to the sovereignty of Nigeria and Africa as the agreement reportedly includes clauses that require underdeveloped and developing nations to support LGBTQ rights as a condition for receiving financial and other forms of support from advanced countries.
But giving that there is an existing legislation against same-sex relationships in Nigeria enacted in 2014, would the controversial Samoa agreement override the anti-gay law that criminalises gay relationships and same-sex marriage and amorous relationships? If benefiting from the $150 billion Samoa Deal is consequnet upon Nigeria abiding by the clauses in the agreement or supporting LGBTQ rights, do we see president Bola Tinubu as one who would abrogate Nigeria's law banning same-sex amorous relationships or recognising the rights of LGBTQI people?
The law signed by former President Goodluck Jonathan in January 2014, contains penalties of up to 14 years in prison and bans gay marriage, same-sex ‘amorous relationships’ and membership of gay rights groups. Would the agreement make the Nigerian government to relegate the anti-gay law?
In as much as we find it difficult to believe our government because of antecedents and broken trust, there are few voices that have maintained that the agreement they saw has no provision for the recognition of LGBT. For instance, Abubakar Akande, the administrative secretary of Nigerian Supreme Council for Islamic Affairs (NSCIA), stated that the 403-page document, containing 104 articles, given to the NSCIA’s Legal Director and did not include provisions for same-sex marriage.
