Members of Akwuke community in Enugu South Local Government Area yesterday, protested against the trial of Labour Party candidate for Enugu South Urban Constituency, Bright Ngene, at the Magistrate's Court.
The community members, who turned up in large numbers, alleged that the trial was politically motivated, alleging that the magistrate was playing a script to send the candidate to prison.
The court which sat on Thursday, witnessed a heated session as three defense lawyers struggled in vain to persuade His Worship, E. D. Onwu to grant a long adjournment in the case.
Defense attorneys C.S Okereke and Benjamin C. Nwobodo, urged the Magistrate to adjourn the case for five days to allow them sufficient time to review and respond to an application filed by the prosecuting counsel. However, His Worship Onwu insisted the court must reconvene the following day (today).
This legal battle has been ongoing since 2017, prior to Ngene's assembly election campaign.
Addressing journalists after the proceedings, Barr. C.S Okereke revealed that the community had sought to discontinue the case and requested a transfer to a different court within Enugu South Magisterial jurisdiction, citing alleged bias and compromise on the part of His Worship Onwu.
"This court is biased. We have filed an application to transfer the case to another court. We believe this court is compromised," Okereke stated. He also mentioned a petition filed with the National Judicial Council (NJC), expressing their dissatisfaction with Onwu’s handling of the matter.
"When Onwu's disposition became unbearable, and conflicting orders emerged, we wrote to the Chief Judge of Enugu State for guidance on which court should hear the case, but received no response. We wrote again without any reply, leading us to escalate the matter to the NJC on June 7, and we received an acknowledgment that the issue is under review."
Okereke accused Onwu of conspiring to imprison his client, thereby preventing him from participating in the rerun election mandated by the Court of Appeal, which annulled Ngene’s election and called for a rerun in eight polling booths.
Reacting to these developments, Akwuke Community members staged a protest, carrying placards condemning His Worship Onwu for not granting a longer adjournment.
Placards displayed messages such as "His Worship E.D. Onwu is grossly lawless and rascal in presiding over the case" and "E.D. Onwu, how much were you paid?"
